This addendum (the "Addendum") to the Woot Math Terms and Conditions (the "Terms and Conditions") is applicable to all Woot Math Users who are Local Educational Agencies as defined by California Assembly Bill 1584 and subject to that Bill and the California Education Code.
The Terms and Conditions, are incorporated herein by reference.
Terms not defined elsewhere in this document are defined in Assembly Bill 1584 and the California Education Code.
By using Woot Math and agreeing to the Terms and Conditions, the Local Educational Agency (the "LEA," or "you" as referred to in the Terms and Conditions) and Woot Math agree as follows.
Assembly Bill 1584 requires that any agreement entered into by the LEA and certain service providers include certain items; the LEA and Woot Math wish to have the Terms and Conditions meet the requirements set forth in the Bill; and the LEA and Woot Math agree that this Addendum together with the Terms and Conditions meet the requirements set forth in the Bill.
Pupil Records continue to be the property of and under the control of the LEA.
Woot Math does not maintain any Pupil-Generated Content to which section 49073.1.A(3) of the California Education Code would be applicable.
By policy, Woot Math does not collect personally identifiable information from or about any Pupil. This policy may only be changed by a written agreement between Woot Math and a LEA. Lacking such an agreement, Woot Math maintains no personally identifiable information for any Pupil (in a Pupil Record or otherwise) and the following statement does not apply. Parents, legal guardians, and eligible Pupils may review personally identifiable information in the Pupil's Records and correct erroneous information by contacting Woot Math with a request for information or correction by any of the contact means (Email, Toll-Free Phone, Mail, or Web Contact Form) shown on our Contact Us webpage.
Woot Math will take actions to ensure the security and confidentiality of Pupil Records, including but not limited to designating and training responsible individuals on ensuring the security and confidentiality of Pupil Records, including the mechanisms for security and confidentiality described in our Privacy Policy and our Student Data Policy.
In the unlikely event of an unauthorized disclosure of a Pupil's Records, Woot Math will report the disclosure to an affected parent, legal guardian, or eligible Pupil by (1) first contacting the LEA and (2) allowing the LEA, at the LEA's sole discretion, to either provide the reports to the affected parties, or to provide Woot Math with contact information for the affected parties so that Woot Math may notify them directly.
Woot Math will not use any information in a Pupil Record for any purpose other than those required or specifically permitted by the California Education Code. Furthermore, Woot Math will not use any information in a Pupil Record for any purpose other than as described and allowed under the Woot Math Terms and Conditions and under the Woot Math Privacy Policy. Furthermore, Woot Math will not use any information that it collects in any way that is not allowed by California's Student Online Personal Information Protection Act (Senate Bill 1177).
Woot Math certifies that Pupil Records will not be retained or available to Woot Math after (1) the termination of use of Woot Math by the LEA; and (2) written notification by the LEA to Woot Math that the LEA has terminated its use of Woot Math and that the LEA is requesting deletion of the applicable Pupil Records. Woot Math will provide written confirmation of the deletion of Pupil Records to the LEA, including specification of any data not deleted as may be required or specifically permitted by Assembly Bill 1584.
Woot Math and the LEA jointly agree to assure compiliance with FERPA, and in particular have agreed to ensure compliance through the terms and procedures described in the Woot Math Terms and Conditions.
